PRELIMINARY INFORMATION FORM

ARTICLE 1 – SELLER INFORMATION

1.2 BUYER

The person who becomes a member of the akar.store online shopping website as a customer. The address and contact details provided during membership registration shall be taken as basis.


ARTICLE 2 – CHARACTERISTICS OF THE PRODUCT SUBJECT TO SALE

The essential characteristics of the goods or services are available at www.akar.store. The Buyer may review the main features of the product during the campaign period.

The prices listed and announced on the website are sales prices. Announced prices and commitments remain valid until updated or changed. Prices announced for a specific period are valid until the end of that period.

The type, quantity, brand/model, color, unit number, sales price, payment method and order details of the product/service are as specified at the time the order is finalized.

Shipping costs shall be borne by the BUYER and are non-refundable.


ARTICLE 3 – GENERAL PROVISIONS

3.1 The BUYER declares that he/she has read and is informed about the essential characteristics, sales price, payment method, and delivery conditions of the product subject to the contract on the akar.store website and has confirmed such information electronically.

3.2 The product shall be delivered to the BUYER or to the person/entity designated by the BUYER within the period specified in the preliminary information section of the website, depending on the distance of the delivery location, provided that it does not exceed the legal 30-day period.

3.3 The SELLER shall not be held liable for failure to deliver the product due to any issues encountered by the cargo company during delivery to the BUYER.

3.4 The SELLER is responsible for delivering the product complete, undamaged, and in accordance with the specifications stated in the order, including warranty certificates and user manuals if applicable.

3.5 The SELLER may supply a different product of equal quality and price before the performance obligation expires, provided that the BUYER is informed and gives explicit approval.

3.6 If the fulfillment of the order becomes impossible, the SELLER shall notify the BUYER before the performance period expires and refund the total amount within 10 days.

3.7 Confirmation of this Preliminary Information Form electronically is required for delivery. If payment is not made or is canceled in bank records, the SELLER shall be deemed released from the delivery obligation.

3.8 In case of unauthorized use of the BUYER’s credit card not attributable to the BUYER’s fault and the relevant bank does not pay the SELLER, the BUYER must return the product within 3 days, provided it has been delivered. Shipping costs in this case shall be borne by the BUYER.

3.9 In case of force majeure or extraordinary circumstances preventing delivery (e.g., severe weather, transportation interruption), the SELLER shall inform the BUYER. The BUYER may cancel the order, request replacement with an equivalent product, or request postponement. Refunds shall be processed within 10 days (or within 7 days for credit card payments).


ARTICLE 4 – RIGHT OF WITHDRAWAL

The BUYER may withdraw from the contract within 14 days from the delivery date of the product without any legal or penal liability and without providing any reason.

For service contracts, this period starts on the signing date. If service performance has started with the consumer’s consent before the withdrawal period expires, the right of withdrawal cannot be exercised.

Expenses arising from exercising the right of withdrawal shall be borne by the SELLER (except for specified shipping cases).

To exercise this right, written notice must be sent within 14 days via registered mail, fax, or email, and the product must be unused in accordance with Article 5.

Refund shall be processed within 10 days upon receipt of withdrawal notice.

Shipping costs paid during purchase are non-refundable.


ARTICLE 5 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for:

  • Products prepared in line with the BUYER’s special requests or personal needs
  • Products not suitable for return due to their nature
  • Perishable goods or goods with expiration risk
  • Audio/video recordings, software programs, and computer consumables whose packaging has been opened

DISTANCE SALES AGREEMENT

ARTICLE 1 – PARTIES

ARTICLE 2 – SUBJECT

This Agreement regulates the rights and obligations of the parties in accordance with Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts regarding the sale and delivery of the product ordered electronically by the BUYER via the SELLER’s website.


ARTICLE 3 – PRODUCT SUBJECT TO CONTRACT

Type, quantity, brand/model, color, sales price, payment method and order details as specified at checkout.


ARTICLE 4 – GENERAL TERMS

The BUYER confirms having read and electronically approved all preliminary information including product features, total price including taxes, delivery cost and duration, and SELLER details.

Delivery shall not exceed 30 days. Shipping costs shall be reflected on the invoice under “Shipping Fee”.

The SELLER may provide an equivalent product of equal quality and price if performance becomes impossible.

If payment is not completed or canceled, the SELLER shall have no delivery obligation.

Credit card misuse clauses and force majeure provisions apply as described above.


ARTICLE 5 – RIGHT OF WITHDRAWAL

The BUYER may withdraw within 14 days of delivery without providing any reason.

Special campaign, promotional or specially imported products prepared for specific occasions are non-returnable.

Returned products must be unused, complete, and undamaged with invoice and return form.

Refund will be processed within 10 days after receipt.

Domestic return shipping is borne by the SELLER; international returns by the BUYER. Shipping fees paid at purchase are non-refundable.


ARTICLE 6 – NON-RETURNABLE PRODUCTS

Single-use goods, copyable software/programs, perishable goods, or goods with expiration risk are non-returnable.


ARTICLE 7 – DEFAULT

If the BUYER defaults, he/she agrees to compensate the SELLER for damages caused by delayed performance.


ARTICLE 8 – COMPETENT COURT

Consumer Arbitration Committees and Consumer Courts at the BUYER’s residence or place of purchase shall have jurisdiction within the monetary limits set by Turkish Law No. 6502.

All disputes exceeding such limits shall be submitted to Consumer Courts (or Civil Courts acting as Consumer Courts where applicable).


IMPORTANT NOTICE

Before signing the delivery receipt, please check whether the package has been damaged during transportation. If damage exists, do not sign any delivery documents and request a damage report from the carrier. Damaged shipments accepted without report shall not be the responsibility of akar.store.


These terms and conditions are governed by the laws of the Republic of Türkiye.
